VISION TRIP AGREEMENT AND WAIVER
This Vision Trip Agreement and Waiver ("Agreement") is made and entered into by and between Plant With Purpose ("Organization") and the undersigned participant ("Participant"). By signing below, the Participant acknowledges and agrees to the following terms:
1. Purpose and Non-employment status. I am participating in the Vision Trip Program (“Program”) of the Organization voluntarily and without coercion, as an act of public service. I understand that (a) I am not an employee of the Organization and I am not required to participate, (b) I will not be paid for my participation, and (c) I am not covered by or eligible for any Organization insurance, health care, worker’s compensation, or other benefits in exchange for my time and participation. Additionally, I acknowledge that:
- I have been fully informed of the scope, logistics, and expectations of the Program, including its purpose and the requirements for my participation.
- By signing this Agreement, the Organization is permitting me to enter the Program subject to the provisions set forth herein.
2. Conduct Requirements. I agree to comply with all policies, safety rules, conduct expectations, and other directions of the Organization. I understand that these include general standards of respectful and professional behavior, adherence to local laws and customs, and compliance with safeguarding principles to protect Children and Vulnerable Adults. I acknowledge that these expectations will be supplemented by a Vision Trip Code of Conduct Agreement, which I will receive and sign after completing safeguarding training, and that failure to follow these standards may result in my removal from the Program at my own expense.
3. Waiver of Plant With Purpose's Liability for Risks and Dangers. I understand that there are certain dangers, hazards, and risks inherent in international travel and the activities included in the Program, including but not limited to risks of injury, permanent disability or death, property damage, and severe social or economic loss, which may result from my actions, inactions, or negligence, the actions or inactions of others, conditions of equipment used, language barriers, differing social cultures, national and local laws, sickness, weather, strikes, natural disasters, civil unrest or hostilities, terrorist activities or acts of war. I understand that the Organization cannot and does not assume responsibility for any such personal injury, property damage, or other loss.
I further understand that the above-listed risks are also associated with any activities undertaken by me which are not included in the Program, including but not limited to individual travel during vacation periods, time extending beyond the termination of the Program, or any other period in which I am not undertaking Program activities. The Organization cannot and does not assume responsibility for any injury, damage, or loss suffered during such times.
4. Assumption of the Risks Involved. Knowing the dangers, hazards, and risks described above, or otherwise associated with participation in the Program, whether foreseen or unforeseen, and in consideration of being permitted to participate, I agree to assume all risks and responsibilities surrounding my participation in the Program, including transit to, during, and from the Program, and to forever release, discharge, and waive any claims against Plant With Purpose for any harm, injury, claims, demands, actions, causes of action, costs, and expenses of any nature whatsoever which I may have or which may accrue to me, arising out of or related to any loss, damage, or injury, including but not limited to suffering and death, except for loss or injury arising out of the gross negligence or willful misconduct of Plant With Purpose.
5. Medical Care. I understand and agree that the Organization does not have medical personnel available at the location of the Program or during transportation or anywhere in the host country. I grant the Organization permission to authorize emergency medical treatment, if necessary, and understand that such action will be subject to the terms of this Agreement. I agree that the Organization assumes no responsibility for any injury or damage that may arise out of or in connection with such authorized emergency medical treatment.
I have consulted with a medical doctor and, if necessary, other health professionals regarding my personal health needs and confirm that there are no health-related reasons or problems which preclude or restrict my participation. I have arranged for adequate hospitalization insurance to meet any and all needs for payment of hospital costs while undertaking the Program. I agree that the Organization is not responsible for attending to any of my medical or medication needs, that I assume all risk and responsibility for such needs, and that if I am required to be hospitalized while abroad or in the United States during the Program, the Organization cannot and does not assume any legal responsibility for payment of such costs.
6. Infectious Disease Policy. I acknowledge and understand that participation in the Program may involve exposure to contagious illnesses (including, but not limited to, COVID-19, influenza, or other infectious diseases) and assume the risk of being exposed to or infected while traveling to or participating in the Program. I understand that this includes the responsibility to be aware of any regional or national health advisories or requirements that may apply to the areas visited during the Program. The Organization assumes no liability for any illness, disability, or death related to contracting an infectious disease.
I agree to follow the Organization’s health and safety measures, which may include, but are not limited to:
- Respecting and following the preferences or requirements of the local team regarding protective measures while visiting the local office, places of lodging and dining, and partnering communities, and while in transit to and from these locations, and being attentive to any regional or national health advisories or requirements in effect during the Program.
- Refraining from attending the trip if I am sick with an infectious illness and/or exhibiting symptoms such as fever, fatigue, coughing, congestion, chills, gastrointestinal issues, or sore throat.
If I cannot attend the trip due to illness or severe injury, trip deposits and balances may be refunded to the original form of payment.
7. Insurance. I am aware that there are other potential risks which cannot be foreseen at this time. I am aware that life, health, and property insurance are available for purchase to reduce such risks, and I am responsible for securing any insurance coverage I deem necessary.
8. Plant With Purpose’s Rights and Powers. The Organization reserves the right to:
- Cancel the Program without penalty.
- Alter or withdraw any part of the Program and make any modifications in the itinerary and/or training program as deemed necessary.
- Terminate my enrollment without refund if my actions violate local or national laws, Organization regulations, or are judged to be injurious to the Program, offensive to the host culture, or damaging to the Organization’s reputation. Such decisions may be made by the trip leader(s) after consultation with the Organization’s CEO.
- Make changes to travel plans due to emergencies or other disruptive situations — such as natural disasters, political unrest, public health concerns, or security threats — with associated costs my responsibility.
9. Travel and Accommodation. I accept responsibility for loss or additional expenses due to delays or other changes in transportation caused by sickness, weather, strikes, or other unforeseen causes. I understand the Organization assumes no liability for loss, damage, destruction, theft, or similar issues affecting my personal belongings. If I become detached from the Program group, fail to meet a departure point, or become sick or injured, I bear all responsibility and costs to rejoin the group. I understand that the Organization is not liable for any injury, damage, or loss related to operating a motor vehicle while participating in the Program.
I understand that Plant With Purpose does not represent or act as an agent for any transportation carriers, hotels, or other suppliers of services connected with the Program. I agree that Plant With Purpose, its governing board, employees, and agents are:
- Not responsible or liable for any injury, damage, loss, accident, delay, or other irregularity caused by a defect in any vehicle or the negligence or default of any company or person providing or performing services in connection with the Program.
- Not responsible for any disruption of travel arrangements or any additional expenses that may result from such disruptions.
10. Legal Problems. I understand that if I have or develop legal problems with any foreign nationals or government while participating in the Program, I will resolve the matter personally and at my own expense. The Organization is not responsible for providing assistance in such circumstances.
11. Photo and Recordings Grant. I understand that the Organization may take photos or videos of me during the Program. I consent to the Organization’s use of my image, voice, name, and story in its digital and print promotional, fundraising, educational, and other communications. The Organization may use this content without obtaining my additional approval or paying me for such use. I grant the Organization all copyrights in and waive any legal claims relating to the content it captures, including those relating to copyright, rights of publicity or privacy, or defamation, or arising from any distortion, blurring, or alteration that may occur in the making, editing, or use of the materials.
12. General Provisions. This Agreement will be binding for the duration of the Participant’s involvement in the Vision Trip program and will remain in effect for any matters arising from the trip, even after its completion. The Agreement will run in favor of, and may be enforced by, the Organization Parties, and will bind the Participant’s heirs, next of kin, and legal representatives. In the event of the Participant’s death, this Agreement shall also bind the Participant’s family, estate, heirs, administrators, and personal representatives.
If any provision of this Agreement is found to be unenforceable, the remaining terms will remain effective. This Agreement will be governed by the laws of the State of California, and any legal actions arising from this Agreement will be conducted in California.
By signing below, I acknowledge that I have read and understood the entire Agreement. No oral representations, statements, or inducements apart from the written terms of this Agreement have been made, and this Agreement constitutes the entire understanding between the parties.
